1) Agreement & Eligibility
By accessing our website or purchasing our e-bikes and cycling goods, you agree to these Terms and our Privacy Policy. You must be at least 18 (or the age of majority in your state) to place orders.
2) Products, Pricing & Availability
We try to keep specifications, availability, and pricing accurate but they may change without notice. If there’s a material error (e.g., obvious pricing mistake), we may cancel or refuse an order and promptly refund you.
3) Orders, Shipping & Delivery

Processing & timelines. We ship within any timeframe we advertise; if none is stated, we ship within 30 days. If we later learn we cannot meet the date, we will seek your consent to the delay or issue a prompt refund, consistent with the FTC’s Mail, Internet, or Telephone Order Merchandise Rule.

Risk of loss; title. Risk of loss passes on delivery to the address you provide (or as required by local law). Inspect packages on arrival and report damage within 48 hours with photos.

Batteries & hazmat. Lithium-ion batteries are shipped using approved carriers and methods; certain lanes (e.g., air) are restricted. UN 38.3-tested cells/packs are required for transport; we follow current IATA/ICAO guidance.
4) Payment, Taxes & Anti-fraud
You authorize us or our payment providers to charge the total at checkout (including applicable taxes and shipping). We may cancel any order we suspect involves fraud, abuse, or violation of these Terms.
5) Returns & Refunds
Our Returns & Refunds Policy (separate page) explains windows, conditions, restocking, and return-shipping. If we shipped the wrong or defective item, we will make it right under our Limited Warranty.
6) Limited Warranty (Summary)
We provide a limited warranty against defects in materials and workmanship for consumer use; details and periods are described on our Limited Warranty page. Your federal rights under the Magnuson-Moss Warranty Act remain in force (e.g., disclosure standards, limits on disclaimers, consumer remedies).
7) Rider Responsibilities, Compliance & Safety

Follow local law. In Florida, e-bikes generally have the same rights and duties as bicycles; Florida recognizes Class 1/2/3 definitions and allows local regulations in specific areas. Always check and obey posted rules.

Federal product scope. “Low-speed electric bicycles” (≤750W, <20 mph on motor-only) are regulated as consumer products by CPSC; many equipment requirements in 16 CFR Part 1512 apply.

Battery care. Charge only with approved chargers on non-flammable surfaces; never use damaged or water-exposed packs. See our Battery & Safety guidance for details.
8) Google Merchant Center / Shopping Compliance (Website-level)
We maintain: (i) secure checkout (SSL/TLS) for PII and payment pages, (ii) clearly available contact information, (iii) at least one conventional payment method, and (iv) clear policies (Shipping, Returns, Privacy, Terms). We do not sell users’ contact info or use personal data/images in ads without consent.
9) User Accounts & Acceptable Use
You’re responsible for account credentials and all activity under your account. Do not interfere with site operation, attempt unauthorized access, scrape without permission, or use products in unlawful ways.
10) Reviews & User Content
By posting reviews or other content, you grant us a non-exclusive, royalty-free license to display and reproduce that content in connection with our store (subject to our moderation rules and applicable law). Do not post false, misleading, or infringing material.
11) Intellectual Property
All site content (logos, product copy, photos, graphics) is owned by Hawk Cyclery or its licensors and is protected by IP laws. You may not reproduce or exploit content without written permission. For alleged copyright issues, contact support@hawkcyclery.com (Subject: “DMCA”).
12) Third-Party Services
We rely on third-party services (e.g., payments, shipping, analytics). Their services are provided “as is” under their own terms and privacy policies.
13) Disclaimers; Limitation of Liability
To the fullest extent allowed by law, the site and products are provided “as is” except as stated in our written warranty. We are not liable for indirect, incidental, special, or consequential damages (e.g., lost profits). Our total liability for any claim related to a product or these Terms will not exceed the amount you paid for that product.
14) Indemnification
You agree to defend and hold Hawk Cyclery harmless from claims arising from your misuse of the products or violation of these Terms or law.
15) California Proposition 65 (if you sell to CA)
Some products (e.g., batteries/chargers, cables) may expose you to chemicals known to the State of California to cause cancer or reproductive harm. See P65Warnings.ca.gov for more information; businesses must provide “clear and reasonable” warnings where required.
16) Governing Law & Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the state and federal courts located in St. Johns County, Florida.
17) Changes to These Terms
We may update these Terms to reflect changes to our practices, technologies, legal requirements, or platform policies. The “Effective date” above will change when we do; continuing to use the site after changes means you accept them.
